China Issues New Export Control Law and Related Policies

On October 17th, 2020, the Standing Committee of China’s legislature, the National People’s Congress (NPC), passed the Export Control Law of the People’s Republic of China, which goes into effect on December 1st, 2020, with regards to the export of sensitive items (including goods, technology and services).
The new “Export Control Law” is divided into five chapters and 49 articles. The main content includes the following parts:
- The scope and objects of export control: including dual-use items, military and nuclear materials and other goods, related technologies and services, export operators, importers and end users are also included in the scope of control, supervision and management;
- Measures and methods of export control: implement lists, catalogs and temporary control measures for the above-mentioned items, and implement an export license management system. The export license application shall be examined and approved by the control management department in accordance with the procedures prescribed by this law;
- The supervision and management responsibilities and powers of the export control management department, as well as the on-site supervision power of the customs on export-controlled goods;
- Investigate the legal responsibility of the corresponding subject for violations of export control order.
